1. Acceptance of Terms

By accessing or using the services provided by Rest Recovery Tampa ("we," "our," or "us"), including our website, mobile applications, and in-person services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms constitute a legally binding agreement between you and Rest Recovery Tampa. We reserve the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any modifications.

2. Services Description

Rest Recovery Tampa provides wellness and recovery services including but not limited to:

• Cold plunge therapy
• Infrared sauna sessions
• Red light therapy
• Compression therapy
• Float therapy
• Hyperbaric oxygen therapy
• Salt therapy
• Other wellness modalities as offered

3. Eligibility

To use our services, you must be at least 18 years of age or have parental/guardian consent. By using our services, you represent and warrant that you meet these eligibility requirements.

4. Health Disclaimer and Assumption of Risk

IMPORTANT: Our services are intended for general wellness purposes only and are NOT a substitute for professional medical advice, diagnosis, or treatment.

Before using any of our services, you must:

• Consult with your physician or healthcare provider
• Disclose all relevant health conditions, medications, and concerns
• Read and acknowledge all safety warnings and contraindications
• Sign our required liability waiver

Certain conditions may make our services unsuitable for you, including but not limited to: pregnancy, cardiovascular conditions, blood pressure disorders, diabetes, epilepsy, recent surgery, open wounds, infectious diseases, and certain medications. This is not an exhaustive list.

You acknowledge and agree that you voluntarily assume all risks associated with using our services, including any injury, illness, or adverse effects that may result.

5. Membership Terms

5.1 Membership Plans

• Membership fees are billed according to the terms of your selected plan
• Monthly memberships auto-renew unless cancelled
• Founding member rates are locked in for the duration of continuous membership
• Membership benefits are non-transferable

5.2 Cancellation

• Monthly memberships may be cancelled with 30 days written notice
• No refunds for partial months or unused sessions
• Cancelled memberships forfeit any locked-in rates upon re-enrollment

5.3 Payment

• All payments are processed securely through our payment provider
• Failed payments may result in temporary suspension of membership
• We reserve the right to modify pricing with 30 days notice

6. Booking and Cancellation Policy

• Appointments must be booked in advance through our booking system
• Cancellations must be made at least 24 hours before the scheduled appointment
• Late cancellations (less than 24 hours) may result in forfeiture of the session or a cancellation fee
• No-shows will result in forfeiture of the session
• We reserve the right to cancel or reschedule appointments when necessary
• Please arrive 10-15 minutes before your scheduled appointment

7. Facility Rules and Conduct

While using our facilities, you agree to:

• Follow all posted rules and staff instructions at all times
• Shower before using cold plunge, sauna, or float services
• Wear appropriate attire as specified for each service
• Maintain respectful behavior toward other guests and staff
• Not use the facilities while under the influence of alcohol or drugs
• Report any equipment issues, injuries, or safety concerns immediately
• Not bring food or beverages into treatment areas unless permitted
• Keep personal belongings secure; we are not responsible for lost or stolen items
• Not engage in photography or recording without express permission

We reserve the right to refuse service or revoke membership to anyone who violates these rules or engages in inappropriate conduct.

8. SMS/Text Message Terms

By providing your phone number and opting in to receive text messages from Rest Recovery Tampa, you agree to the following:

• You consent to receive automated text messages for appointment reminders, confirmations, and service notifications
• If opted in, you consent to receive promotional messages about offers, deals, and updates
• Message frequency varies based on your activity and preferences
• Message and data rates may apply according to your mobile carrier plan
• You can opt out at any time by replying STOP to any message
• For help, reply HELP or contact us directly
• Carriers are not liable for delayed or undelivered messages
• Your consent is not a condition of purchase

9. Electronic Communications

By using our services or providing your contact information, you consent to receive electronic communications from us, including:

• Transactional emails (confirmations, receipts, appointment reminders)
• Service updates and important notices
• Marketing communications (if opted in)

You agree that all agreements, notices, and communications provided electronically satisfy any legal requirement that such communications be in writing.

10. Liability Waiver and Release

PLEASE READ CAREFULLY: To the fullest extent permitted by law:

• You acknowledge that wellness therapies involve inherent risks
• You voluntarily assume all risks associated with using our services and facilities
• You release and hold harmless Rest Recovery Tampa, its owners, officers, employees, agents, and affiliates from any and all liability, claims, damages, or expenses arising from your use of our services
• This release includes, but is not limited to, personal injury, illness, death, property damage, and any other losses

This waiver does not apply to claims arising from our gross negligence or willful misconduct.

11. Limitation of Liability

To the maximum extent permitted by law, Rest Recovery Tampa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of our services.

Our total liability for any claims arising from your use of our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rest Recovery Tampa and its affiliates from any claims, liabilities, damages, losses, or expenses arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Any misrepresentation made by you

13. Intellectual Property

All content on our website and in our facilities, including but not limited to text, graphics, logos, images, videos, and software, is the property of Rest Recovery Tampa and is protected by intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or use our content for commercial purposes without our prior written consent.

We will make reasonable efforts to notify you of material changes. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

We may terminate or suspend your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services will immediately cease.

17. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver: You agree to resolve any disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

18. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any legal proceedings shall be brought in the state or federal courts located in Hillsborough County, Florida.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other agreements you enter into with us, constitute the entire agreement between you and Rest Recovery Tampa regarding your use of our services.
